Why the rate depends on the loan category

The NCR definition of a short-term credit transaction covers amounts up to R8 000 repayable within 6 months. Sigonde Black Mamba offers up to R10 000, so loans above R8 000 must be priced under the applicable NCA credit category rather than using a blanket short-term rate.

Applicable NCA category

For an unsecured credit transaction, the maximum prescribed interest formula is Repo Rate + 21% per year. The exact rate offered must be within the applicable regulatory ceiling and disclosed before agreement.

Calculated according to the applicable NCA/NCR rules and not above the prescribed maximum.
Initiation fee
Only a permitted initiation fee may be charged, within the prescribed maximum for the agreement.

Any service fee must remain within the prescribed regulatory ceiling.
Other charges
No costs may be charged unless permitted by the National Credit Act and applicable regulations.
Full disclosure
The pre-agreement statement and quotation must show the cost of credit before the consumer signs.

No hidden or unlawful charges

The final quotation is the customer’s key pricing document. Regulatory limits can change; the rate and fees applicable on the agreement date govern the transaction.

We do not retain or use a consumer’s bank card, ATM card, PIN or original identity document as a method of collecting or enforcing a debt.

Where legal debt enforcement is necessary, the required notices and processes under the National Credit Act must be followed.

Consumers must be notified before adverse information is submitted to a credit bureau where the law requires such notice.

National Credit Act / NCR Controls

  • Credit marketing and advertising must comply with the Act and disclose cost of credit where required.

Assurance Engagement

For non-audited credit providers, the NCR guideline requires an appropriate practitioner to perform the Regulation 68 assurance engagement and report on compliance findings. Management must support the process with relevant records, representation and corrective-action tracking where required.

FIC / AML Responsibilities

Credit providers are accountable institutions under Item 11 of Schedule 1 to the Financial Intelligence Centre Act. This creates additional obligations such as FIC registration, risk-based customer due diligence, record keeping, an RMCP and prescribed regulatory reporting.
